Layernode Terms of Service

Article 1 (Purpose)

These Terms of Service are intended to define the responsibilities and obligations between Layernode (hereinafter referred to as "Company") and customers, as well as other necessary matters, in using VPS hosting and DDoS protection services (hereinafter referred to as "Services") provided by the Company.

Article 2 (Effectiveness and Amendment of Terms)

① These Terms become effective by being posted on the service screen or notified to customers by other means.

② The Company may amend these Terms within the scope that does not violate relevant laws when necessary, and the amended Terms will be announced 7 days prior to implementation.

③ If customers do not agree to the amended Terms, they may discontinue service use and terminate the service contract.

Article 3 (Definition of Terms)

① "Service" refers to VPS hosting, DDoS protection, and related supplementary services provided by the Company.

② "Customer" refers to individuals or legal entities using services provided by the Company under these Terms.

③ "VPS" refers to Virtual Private Server, which provides an independent server environment.

④ "DDoS Protection" refers to security services that protect customers' services from Distributed Denial of Service attacks.

Article 4 (Establishment of Service Agreement)

① A service agreement is established when the customer agrees to these Terms, completes the service application, and the Company accepts it.

② The Company may refuse to provide services in the following cases:

  • Using a name that is not real or impersonating another person
  • Providing false information or failing to provide information required by the Company
  • Intending to use the service for illegal purposes
  • Not meeting other usage conditions set by the Company

Article 5 (Service Provision)

① The Company provides services 24 hours a day, 365 days a year in principle.

② The Company may temporarily suspend service provision in the following cases:

  • When necessary for system maintenance, expansion, or replacement
  • In case of network failures or service suspension by telecommunications operators as stipulated in the Telecommunications Business Act
  • When there are force majeure events such as natural disasters or national emergencies

③ When suspending service provision, the Company will notify in advance, or may notify afterward if unavoidable.

Article 6 (Company's Obligations)

① The Company shall continuously strive to provide stable services and promptly recover in case of failures.

② The Company shall establish and comply with a privacy policy to protect customer's personal information.

③ The Company shall not disclose or distribute customer information learned in relation to service provision to third parties without the customer's consent.

Article 7 (Customer's Obligations)

① Customers must pay service fees within the agreed deadline.

② Customers must not engage in the following activities:

  • Stealing other people's information
  • Using services provided by the Company for illegal purposes
  • Disrupting other users' services through DDoS attacks, hacking, etc.
  • Distributing materials that violate laws such as pornography or illegal programs
  • Using excessive server resources that affect other users' services

③ Customers must comply with relevant laws, provisions of these Terms, usage guidelines, and precautions.

Article 8 (Contract Termination)

① Customers may terminate the service agreement at any time.

② The Company may terminate the contract after prior notice in the following cases:

  • When the customer violates the obligations of Article 7
  • When service fees are delinquent two or more times
  • When significantly disrupting other users' service usage or adversely affecting the system

Article 9 (Refund Policy)

① When requesting a refund before service commencement, 100% of the payment amount will be refunded.

② After service commencement, refunds will be calculated on a daily basis for the remaining amount after deducting used days.

③ Refunds may be restricted when service is suspended or contract is terminated due to customer's fault.

Article 10 (Damages Compensation)

① The Company shall not be liable for damages compensation for services provided free of charge.

② In case of service suspension due to the Company's fault, the service period will be extended for the corresponding period.

③ The Company shall not be liable for service suspension due to force majeure events such as natural disasters.

Article 11 (Disclaimer)

① The Company shall not be liable for customers not obtaining expected profits or losing them through service use.

② The Company shall not be liable for damages caused by materials obtained by customers while using the service.

③ The Company shall not be liable for the reliability, accuracy, etc. of information and materials posted by customers on the service.

Article 12 (Dispute Resolution)

① The Company and customers shall make necessary efforts to resolve disputes related to the service amicably.

② In case of disputes related to these Terms, the court having jurisdiction over the Company's headquarters location shall have jurisdiction.

Article 13 (Service Extension and Expiration)

① Customers may apply for service extension before the service expiration date.

② If the service is not extended by the expiration date, the service will be automatically suspended, and data may be deleted after a certain period.

③ The Company shall notify customers in advance before service expiration.

Article 14 (Additional Cost Notification)

① The Company may charge additional fees for services beyond the basic scope of service provision.

② Additional fees may be charged when customers request customized services or special tasks.

③ If payment is not made within 3 days from the service expiration date, a late fee of 3% will be charged.

④ When an engineer manually performs tasks at the customer's request, a fee of $3 will be charged.

Article 15 (Administrative Termination)

① The Company may implement null routing or administratively terminate services without prior notice in the following cases:

  • When the attack capacity exceeds 200Gbps, which is the mitigation capacity provided by our service

② In case of unauthorized reselling of services, the Company will refund 10% of the fees paid by the customer to purchase the service.

Supplementary Provisions

These Terms shall be effective from January 1, 2024.
